On September 23, 2022, the Florida Department of Insurance filed a petition to place FedNat Insurance Co. in receivership. The petition alleges that FedNat acknowledged in September 2022 that it did not have enough cash on hand to meet its current obligations. FedNat was undertaking a plan to reconstitute the insurance business and keep it operating, but that plan appears to have failed.
FedNat was at one point the fourth largest homeowners’ insurer in Florida, reported to have as many as 272,000 homeowners’ policies in effect in Florida. That number was down to 140,000 policies earlier this year, when 56,500 were cancelled as part of an attempt to reorganize, according to the petition.
The petition alleges FedNat has agreed to a consent decree for its liquidation.
Counsel hired by FedNat in a civil case have filed a motion to stay the lawsuit because of the impending liquidation of FedNat, which also provided commercial general liability insurance to
some insureds.
